Queensland incorporated associations can now transfer to company limited by guarantee

A Queensland incorporated association may now easily transition to becoming a company limited by guarantee.

Amendments to the Associations Incorporation Act 1981 (Qld) which came into effect in December 2011 allow an incorporated association to apply to the Office of Fair Trading for authority to transfer its incorporation to that of a company limited by guarantee under the Corporations Act 2001 (Cth). If granted authority, the incorporated association may then apply to the Australian Securities and Investments Commission for registration.
